Preparing your case

Every VCAT case is unique and our approach will vary depending on your situation.

 Here's a general overview:

1. **Case Assessment:**
   Square Investments Real Estate starts by thoroughly assessing your situation. We need to understand the legal and factual basis for your case, as well as the strength of your arguments. This includes gathering all relevant documents, contracts, correspondence, and other evidence related to the real estate transaction or dispute. We will provide you honest feedback on the success of your application and likelihood of success or failure.

2. **Document Preparation:**   

  Our team will complete the necessary legal documents, including a Notice to vacate, Application and summary of proofs. These documents outline the case, present the evidence, and state the remedies sought from the VCAT.

3. **Formulation of Arguments:**
   Based on the evidence and agreed strategic plan, Square Investments Real Estate will formulate their arguments and positions. This involves identifying key legal points, relevant laws, regulations, and precedents, and creating a clear and persuasive narrative to present to the VCAT.

4. **Witness Statements and Evidence Compilation:**
   If there are witnesses who can provide testimony supporting Square Investments Real Estate's case, their statements would be prepared in the required form. Any other relevant evidence, such as photographs, contracts, emails, and expert reports, would also be compiled to strengthen the case.

5. **Hearing Preparation:**   

  In the lead-up to the hearing, Square Investments Real Estate's legal team would thoroughly prepare witnesses for their testimony, review legal arguments, and anticipate potential questions or challenges from the opposing party or VCAT.

6. **Exchange of Information:**
   As part of the VCAT process, both parties are required to exchange relevant documents and evidence within 7 days prior to the hearing. Square Investments Real Estate would ensure that all required materials are provided to the opposing party as per the rules.

7. **Pre-Hearing Conferences:**
   Before the formal hearing, the parties might attend pre-hearing conference where procedural matters are discussed, evidence is reviewed, and attempts at settlement are made. This is also an opportunity to clarify any points of contention and potentially narrow down the issues for the main hearing.

9. **VCAT Hearing:**
   During the hearing, both parties present their cases, call witnesses, and present evidence before the VCAT member. Square Investments Real Estate's team would present their arguments, cross-examine and respond to any arguments presented by the other party.

​

11. **VCAT Decision:**
    The VCAT member or panel will review the evidence, arguments, and submissions before making a decision. This decision will be communicated to both parties in due course.
